Essentials of Workshops
A permanent Awareness center can be formulated as the main workshop to capture the victims and dependants or sympathizers at any time without any hesitation to obtain the real gravity of support. It shall be in the identified area or at the district headquarters . With the co-ordination of a special officer not below the rank of an additional Magistrate who appointed by the District Magistrate, Suprendentant of Police or other officers responsible for implementing the provisions of the Act 33of 1989, various committees and the SC/ST Protection Cell. The Workshops shall providing immediate relief and other facilities to the victims of atrocity and initiate necessary measures to prevent or avoid re-occurrence of atrocity.
Definitions of Non Government Organizations (NGO)
The notification from the Ministry of Welfare ,G S.R.316(E) New Delhi ; the 31st March 1995, Gazette of India (Ext) Part II, section 3(1) ,dated 31-3-1995 at page 24, .Discloses that in exercise pf the powers conferred by sub-section (1) of Section 23 of the SC/ST(POA) Act1989 (Act 33of 1989) the Central Government hereby makes the rules .Under section 2(d) defines the Non Government Organization (NGO) means a voluntary organization engaged in the welfare activities relating to the Scheduled Castes and Scheduled Tribes and registered under the societies Registration act1860(21of 1866) or under any law for the registration of documents or such organization for the time being in force.. According to the said rule in Kerala , the Travancore Cochin Literary Scientific and Charitable Societies Registration act.1955,any organization registered under Act1955 shall deemed to be a Non Government Organization. Therefore the Pattikajathi Kshema Samithi is dejure as Non Government Organization, that engaged in the welfare activities relating to the Non Government Organization Scheduled Castes and Scheduled Tribes since 2002.
Role and Responsibility of NGOs
The role and responsibility of the NGos defined under section 15 of SC/ST(POA) Rules 1995. It defines that the state government shall prepare a model contingency plan for implementing the provisions of the Act and modify the same in the Official Gazette of the State Government. It should specify the role and responsibility of Rural/ Urban ,Local Bodies and Non Government Organizations. Inter alia ,this plan shall contain a package of relief measures including
a) scheme to provide immediate relief in cash or kind or both ;
b) allotment of agricultural land and house - sites;
c) the rehabilitation packages ;
d) mandatory compensation for the victims,
And provisions for providing bricks/stone masonry house to the victims. Such elements as health care , supply of essential commodities , electrification, adequate drinking water facility ,burial /cremation ground and link roads to SC/ST habitats.Under Rule 3(viii) of (POA) defines that set up awareness center and organizing workshops in the identified area or at some other place to educate the persons belonging to Scheduled Castes and Scheduled Tribes about their rights and the protections available to them under the provisions of various Central and State enactments or rules , regulations and schemes framed there under. According to the said rules 15 the Pattikajathi Kshema Samithi were undertaking in the similar tasks since 2002.
Resource of NGOs
There are two ways of resources to sustain NGOs activities in its tasks to face .
First To collect financial assistance from general public and business houses with due receipts
Second: Obtain grant-in –aid from the government under rule 3(ix) of (POA) Rules.1995
At first part: , if a charitable organization established by the Scheduled Castes , the general public including business houses treating such NGOs in a bieasical attitude when they approach for donations due to most of the business houses belongs to upper classes and treated differently by the general public also. It is a matter of fact that the Samithi members and the board of management are not such wealthy or financially sounded to sustain such tasks in due course.
Second Part is the grant –in –aid from the government. With a view to the parliament enacted several rules to provide encouragement in the performance of such NGOs by SC/ST(POA) Rules 1995. Section 3(ix) as above and section 3(viii) the Special Officer Under section 10 of the said rules , it is the duty of him to co- ordinate with the NGOs and providing necessary facilities and financial and other type of assistance to NGOs.
NGOs in Kerala
There are thousands and above charitable societies registered in each districts in Kerala. Each and everyone are motivated for several classes other than SC/STs and nothing can be done in favor of the victims of atrocity, according to the Act 33 of 1989.But the Pattikajathi Kshema Samithi Reg: No; K-226/2002, Manjoor, is the first and only charitable organization having such objects in Kerala state.
Pattikajathi Kshema Samithi- a NGO for SCs.
Pattikajathi Kshema Samithi registered under the Travancore Cochin Literary Scientific and Charitable Societies Registration Act.1955, having its Head office at Manjoor Panchayath , Manjoor PO. Pin: 686 603, Vaikom Taluk of Kottayam District.,Kerala State having its register number K -226/2002of District Registrar (General)Kottayam.The objects of this organization discloses for the welfare of scheduled Castes in Kerala .This NGO undertaking in educational, economic, atrocity eradication, and ‘Untouchability ‘ eradicational programmes since2002.This NGO obtained the exemption certificate of 80G (5)of Income Tax Act 1961 from the Commessionerate of Income Tax Office at Kottayam from a period of 2008 to 2011 and having the register Number C. No: 305/T/80G/(35)/CIT/KTM2007-08. Therefore the donations made to the Pattikajathi Kshema Samithi will be eligible to the benefit of deduction U/s 80G of Income Tax act1961 in the hands of the donors subject to the limits and conditions prescribed therein.The state government satisfied and appreciated that this NGO belongs to Scs and having its tasks for the welfare of Scs in Kerala state as per file no:31493/A1/2006/Rev. Dated 25-10-2007.However the state of Kerala disregarded even to make an order for the performance of encouragement as financial and other type of assistance . Unless such an Order executed and publish in the Official Gazette of Kerala this NGO facing genuine difficulty to sustain its activities to set up awareness center and maintaining Center.
Beneficiaries of Awareness Center and Organizing workshops
There are a total number of 3123941SC members including 1525114 Male and 1598827 Females and a total number of 364189 STs. Members including 180169Male and 184020 females are the beneficiaries when the Awareness Center and Organizing workshops been established by this NGO, Pattikajathi Kshema Samithi.
Head Quarters
The permanent Head Quarters of the Awareness Center shall be located at the Head Office of the Pattikajathi Kshema Samithi. Manjoor .PO.Pin. 686 603. Kottayam , Kerala or at the District Head Quarters at Kottayam District.
System of Awareness Center & Maintaining Center.
A victim of atrocity is the most important visitor of Awareness Center. The NGO receives an information from any person or from such victims or his/her dependants or sympathizers or upon its own knowledge or through medias that an atrocity has been committed on the members of SC/STs, within the jurisdiction around Kerala ; this NGO will immediately visit the place of occurrence to asses the extant of atrocity , loss of life, loss and damage of the property and submit a report to the District Magistrate , or sub-Divisional Magistrate , or any other Executive Magistrate , or any Police officer not below the rank of DYSP. of the area and recommending for immediate relief to the victims. Every commission relating to an offence of atrocity this NGO providing legal- aid and support to the victims and providing immediate relief’s if necessary to the victims of atrocity and dependants in cash or kind or medicines, food, blood transfusions etc; depending upon the gravity of the offences.
Essentials of Awareness Center.
A permanent Awareness Center under this NGO is require at least 50 cents of land to construct Office Building and an auditorium with an assembly of 1000 persons . A vehicle is required to use as an Ambulance cum carrier to use for publicity to the cultural programmes , untouchability eradication programmes and seasonal utility .The fund raised from the government has kept separate book of account and permitting periodical verification. The grant-in-aid obtaining through the account of this NGO is at State Bank of Travancore, Vaikom Branch, A/C .Number 57039415067.The Ministry of Social Justice and Empowerment cannot provide relief and rehabilitation to the victims direct even in respect of heinous crimes committed against SCs like arson, rape, murder etc;. Therefore , a need has been felt to provide instant monetary relief to the victims in the nature of contingency arrangement and the relief amount be directly provided to the victims by the Central Government through the Pattikajathi Kshema Samithi in kerala. Therefore the suitable scheme for financial assistance and Awareness Center as other type of assistance to the SC victims of atrocities by the Pattikajathi Kshema Samithi would be a befitting tribute to this illustrious son of Kerala.
